What ProfitSignal is — and is not

ProfitSignal is a software tool that finds, scores, and explains general opportunities and market information in plain English. It is an information and discovery service only. It is NOT a broker-dealer, investment adviser, financial planner, or trading platform, and it does not provide personalized investment advice. It never trades, holds funds, or moves money on your behalf.

No financial advice

Nothing in ProfitSignal is a recommendation that you buy, sell, or hold any security, cryptocurrency, or other asset, or that any strategy is suitable for you. The information is general and impersonal. You are solely responsible for your own decisions and should consult a licensed professional before acting. Eligibility and your account

• You must be at least 18 years old (or the age of majority where you live).
• You are responsible for keeping your login credentials secure and for all activity under your account.
• You agree to provide accurate information and keep it current.

Acceptable use

You agree to use ProfitSignal lawfully. Our Acceptable Use Policy is part of these Terms and prohibits abusing, scraping, reverse-engineering, or overloading the service, and any use that violates law or third-party data-source terms.

Subscriptions and billing

• ProfitSignal may offer free and paid plans. Paid plans, where available, are billed in advance on a recurring basis through our payment processor and renew automatically until cancelled.
• You can cancel at any time; cancellation takes effect at the end of the current billing period.
• We may change prices with reasonable advance notice; changes apply to future billing periods.

Third-party data

ProfitSignal relies on third-party market and data feeds we do not control. We cannot guarantee that data is complete, current, or accurate, and feeds may be delayed or unavailable. Signals and scores are generated from this data and from automated logic — they are not predictions and are not guarantees.

Disclaimers

ProfitSignal is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, accurate, or profitable.

Limitation of liability

To the fullest extent permitted by law, Smith Medical, P.C. and its affiliates will not be liable for any trading or investment losses, lost profits, or indirect, incidental, special, or consequential damages arising from your use of ProfitSignal. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim (or USD $100 if you paid nothing).

Termination

You may stop using ProfitSignal and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk.

Changes to these Terms

We may update these Terms from time to time. We will update the “last updated” date and, for material changes, provide notice. Continued use after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the United States and the state in which Smith Medical, P.C. is organized, without regard to conflict-of-laws rules.
